MUNICIPAL COURT

 

A division of the Circuit Court of Perry County, Missouri

 

The Municipal Court of the City of Perryville shall be subject to the rules of the Circuit Court of which it is a part, and to the rules of the State Supreme Court.  The Municipal Court shall be subject to the general administrative authority of the Circuit Court, and the judge and court personnel of said court shall obey his directives.  The Municipal Judge shall hold his elected office for a period of two years. 

 

The jurisdiction of the Municipal Court shall extend to all cases involving alleged violations of the ordinances of the City.

 

The Municipal Court and the Municipal Court Clerk’s office are located at 215 North West Street, Perryville, Missouri  63775.  Office hours are Monday through Friday, 7:30 A.M. to 5:00 P.M.

 

Municipal Court is held the first Wednesday of the month.  Entrance to the Municipal Court is on the east side of the building off Grand Avenue.  Municipal Court begins at 9:00 A.M.

READ BEFORE PAYING YOUR TICKET

 

You must respond to your ticket within thirty days by either pleading guilty and paying the fine and court costs, or by pleading not guilty before the Municipal Judge and your case will be set for trial.  Pursuant to Section 2.68.350 of the City of Perryville Code of Ordinances, any person who fails to appear in Municipal Court on the date and time referred shall be guilty of failure to appear and shall be subject to punishment as provided in Section 1.16.010, by a fine not exceeding $500 and costs, or by imprisonment not exceeding three months, or by both fine and imprisonment.  Failure to respond as required may also result in suspension of your driver’s license and a warrant may be issued for your arrest.

 

TO PLEAD GUILTY AND PAY YOUR FINE:

  • Sign the back of your ticket or a copy and return it in the pre-addressed envelope you received.

  • Determine the amount from the back of this page or by calling 573-547-2594.

  • DO NOT SEND CASH!  Send check or money order for the full amount (partial payments are not acceptable).

  • Make your check payable to the Municipal Court – Perryville.  Write your ticket number and daytime phone number on the front of your check or money order.

  • The ticket may be paid in person at the above address between the hours of 7:30 a.m. to 5:00 p.m. Monday through Friday.

THE COURT WILL NOT CONTINUE YOUR CASE BY PHONE THE DAY SET FOR YOUR APPEARANCE.  The law presumes you are innocent of this charge until the City proves you guilty beyond a reasonable doubt.  The law also guarantees you the right to consult your attorney, to request a trial, to remain silent at trial or during any court proceedings, to cross-examine adverse witnesses, to subpoena witnesses for your defense, and even to disqualify the Judge if you believe he is bias against you.  These rights can’t be taken from you – you can only lose them by pleading “guilty”.  If you desire to plead “not guilty”, it will be necessary for you to appear in Municipal Court at the date and time indicated on your ticket, so that a trial can be scheduled.

Section 10.12.201.  Add $250 to amount due for speeding or passing in a “Construction or Work Zone with workers present and when signs are posted stating the following message:

 

Warning:  Minimum $250 fine for speeding or passing in this Construction or Work Zone when workers are present” or add $35 to any moving violation that indicates the offense occurred in a construction or work zone when no minimum fine signs are posted.
